VACATION PROPERTY RENTAL AGREEMENT
This Vacation Property Rental Agreement (the “Agreement”) is by and between ACO VACATION HOMES, as agent for Homeowner, and
"Guest", an individual, for the short-term rental of a property. For good valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
Please read this Agreement in its entirety.
1. DOCUMENTS REQUIRED
To validate the reservation, Guest must send to us by email all required documents listed below (reservations@acovacationhomes.com): (a) This Rules and Agreement executed by Guest/credit card holder. (b) A legible copy of identification document with picture from the credit card holder. (c) A legible copy front and back of the credit card used to book the vacation home. (d) If a new credit card is provided as a new payment method, Guest must send all documents required in reference of the new credit card as well.
2. MINIMUM AGE
We will not grant a license to any Guest under the age of 21 years old, unless accompanied by an adult, 21 years old or older, or parent. No children or minors can occupy or use the property without the presence of an adult, 21 years old or older.
3. OCCUPANCY
Guest is aware of the limit on the number of Guests allowed on the property during rental period. In case of any violation of the occupancy limit, ACO has the right to cancel the rental contract immediately. If an additional Guest is desired, ACO must be notified and we must authorize. In case of approval a daily fee of $25.00 (twenty-five dollars) plus taxes per person will be charged on the credit card on file. Guest must inform ACO Vacation Homes ("ACO") of the name and age of all Guests that will be on the property. ACO has the right to inspect the house at any time.
4. QUIET ENJOYMENT
Guest shall be entitled to the quiet enjoyment of the property. Any disturbance resulting in police action, neighborhood complaints or any violation of the rules and regulations is considered sufficient cause for immediate termination of your stay with all monies paid forfeited.
5. CHECK-IN, PROPERTY ACCESS and CHECK-OUT
Check-in at the property is 4:00 pm or after, and Check-out is promptly by 11:00 am. There are no early check-ins or late check-outs permitted without prior written consent from ACO and the request needs to be submitted 24 hours prior of arrival. Time violation under penalty of extra charge. No refunds will be given for early departures or late arrivals. $100.00 will be charged after 15 minutes for the first hours. After 1 hour late a new daily rate plus $100.00 will be charged per hour on the credit card on file.
6. CHECK-IN PROCEDURES
Guest agrees to follow check-in procedures as shown below:
(a) Online Check-In: ACO Vacation Homes voucher containing the check-in instructions and access codes will be generated and released one day prior to the Guest Arrival date only if the reservation is fully paid and all documentation required is received. On the voucher, Guests will have the property address, door code, Wi-Fi password, as well as other important information about their stay.
ACO VACATION HOMES check-in procedure is completely electronic for Guests' convenience. Guests can go straight to their houses with the codes provided on the voucher sent on guest email 24h prior to check in. No one will greet the guest at the property. Check in will not be possible in person. Everything needs to be done online prior.
7. CHECK-OUT PROCEDURES
Guest agrees that if they fail to vacate the property by
a.m. on the check-out day, a late fee of $100.00 (one hundred dollars) plus taxes will be charged after 15 minutes late. An additional $100 per hour and a fee of one nightly rate will be applied and charged to the credit card on file for every other hour. Late check-out must be notified and written authorized by ACO Vacation Home in advance.
8. DAMAGE PROTECTION
ACO Vacation Homes along with homeowners make every effort to have all furnishings and appliances in working order prior to the check-in. Upon arrival, If Guest notice any cleaning problems, irregularities or maintenance issues, immediately notify ACO Vacation Homes in writing (attaching pictures) to reservations@acovacation homes.com. It is Guest's responsibility to contact us in the first 24 hours of Guest arrival. After the first 24h of stay ACO will not consider Damages or cleaning problem as prior existing. If any damage occurs during Guest stay, Guest must also report such damage before the check-out date, in this way we can make every effort to get the repair work done as soon as we are able to and submit a claim to the accidental damage protection accordingly with their Terms of Waiver. Otherwise the Guest will pay for any damage even if the Accidental Damage Waiver was hired.
ANY DAMAGE NOT REPORTED PRIOR CHECK OUT WILL BE GUESTS' RESPONSIBILITY AND THEY WILL BE CHARGED FOR THAT.
9. CREDIT CARD PAYMENT
In accordance with Florida State Law, we reserve the right to use the credit card authorization to cover any damage/repair, such as but not limited to damages, unauthorized pool heating, breakages, excessive trash removal, stains and missing items that occur during Guest's stay in the house. The Guest acknowledges that a form will be sent by email and must be signed immediately. The Guest also agrees to fill out the form in good faith. House will be inspected within 48 hours of Guest check-out. If damages are found and ACO was not notified by the Guest before check-out, the $60.00 (sixty dollars) fee for "accidental damage waiver” will not be activated. The Guest will be charged the total amount of the damage directly from the credit card on the agreement.
10. SECURITY
In case of emergency please call 911. For Guests safety, please make sure to always keep all windows and doors closed and locked. Homeowner and ACO Vacation Homes are not responsible for damages or stolen personal items at the property during Guest's stay. It is the responsibility of the Guest to properly secure the house when leaving the property. When needed, we always inform our Guest the name of the person who will contact them such as: plumber, handyman, etc. If any unauthorized person tries to contact Guest, please call us immediately at (407)326-9400. Do not give access to any unauthorized person. In case house gets robbed ACO and homeowner will not be responsible for Any stolen or damaged personal belongs.
11. AIR CONDITIONING
Upon arrival air conditioner will be already set up to a pleasant temperature and should NOT be set lower than 71 degrees Fahrenheit or above 78 degrees Fahrenheit to prevent any form of damage to the equipment. If the A.C. unit freezes or is damaged, Guest will be liable for charges and repairs. Please keep all windows and doors closed while the air conditioning is “ON” to maintain temperature, reduce humidity and save energy. If assistance is needed to change A/C temperature, please do not hesitate to contact us during business hours by phone (407) 326-9400.
12. BATHROOMS
Please do not flush sanitary napkins, paper towels or anything other than toilet paper. For Guest's convenience, toilet plungers are provided. If a professional plumber is needed, all related costs will be charged on the credit card on file.
13. INTERNET ACCESS
All Homeowners provide complimentary internet access as a courtesy for our Guests. The service is not under our control, therefore ACO Vacation Homes cannot and will not be responsible for interruption of this service. However, we will do our best to troubleshoot issues and ensure the service provider is aware to take the proper actions in the event of slowdown or lack of connection. Refunds will not be given for internet related issues. Information needed to use the internet (password and/or usernames) will be available on Guest's voucher.
14. SMOKING
This property is completely NON-SMOKING. Without exception, no smoking is allowed inside the house or in the property. If smoking inside the house occurs, there will be an additional non-refundable fee of $500.00 (five hundred dollars) plus taxes charged to the credit card on file.
15. GRILL
Guests are welcome to use the grill as a courtesy of ACO Vacation Homes. A $60.00 plus tax mandatory cleaning fee is required. However, its gas propane is Guest’s responsibility, we do not provide it. In case you want to use the grill, please call reservation department during business hours to pay the mandatory cleaning fee and request the code to unlock the grill. In case Grill or locker are missing or damaged Guest will be responsible for it. Grill $300.00. Locker $70.00.
16. POOL & SPA (if applicable)
NO LIFEGUARD ON DUTY, SWIM AT YOUR OWN RISK - No running or horseplay in the pool and deck area, as this may cause serious injury. Pool Heating & Equipment are NOT to be tampered with by Guests. Please note that we do not have control over pool heating not working and in such case, contact us immediately. No glass allowed at pool area. No Kids allowed at the pool area without and a capable adult to rescue them if necessary.
Pool/ SPA heating upon request, 24 hours in advance, minimum of 5 days, pool heating fee of U$40.00 per day plus taxes. If requested, pool heating will be turned on at the check-in day between 11 a.m. and 4 p.m. Pool heating takes up to 24hrs to achieve a comfortable temperature. We regret that a refund of this length of time is not possible as the pool heater is still running. Unauthorized pool heating will be charged on the credit card on file.
17. PARKING
ACO Vacation Homes will not be held responsible for any parking irregularities. Refunds for fines, towing or other will not be given, all will be at vehicle owner’s expense. Please park Guest's car according to the resort rules, some resorts offer free space to park and others reserved spaces for occupants only. Please, read the signs for overnight parking as well.
18. PET POLICY
NO PETS ALLOWED. For the convenience of other Guests and to help us provide the most sanitary accommodations available, pets are not permitted. If Guest brings a pet, Guest's credit card will be charged a non-refundable fee of US$450.00 (Four Hundred and Fifty U.S Dollars) plus taxes per pet and Guest could be additionally charged for any pet stain or other damages caused by the pet. Rental contract will be terminated. EXCEPTION: SERVICE DOG is allowed with no extra charges to be applied. Owner of the support pet MUST be responsible for the sanitary condition of the property.
19. NO PARTIES ALLOWED
In case of violation, ACO Vacation Homes reserves the right to inspect the property at any time, the rental agreement will be terminated and a $500.00 (five hundred dollars) plus taxes fee will be charged to reservation holder credit card. No exception!
20. TRASH / TRASH REMOVAL
Guest will be expected to fully empty trash bins and dispose of garbage bags in appropriate compactor (varies per communities). There will be an additional US$100.00 (One hundred U.S Dollars) fee plus taxes per bin, charged to the credit card on file for an excessive amount of trash left in the house.
21. MANDATORY CLEANING
The cleaning fee charged on the reservation is related to the final cleaning after Guest check out. Guest is aware and agrees that cleaning fee or any other additional cleaning that has been paid for does not include excessive amount of trash that needs to be removed and damages or stain on the carpet and linen or any other furniture such as sofa, mattress, pillows that will need to be cleaned/removed or replaced.
22. MANDATORY ADDITIONAL CLEANING
For bookings with more than 15 (fifteen) days of stay, a mandatory cleaning service needs to be added to Guest's stay. Guest agrees to pay for the additional cleaning and allows the cleaning staff to have access to the property. Time and date for the additional cleaning will be scheduled between Guest and property management company.
23. INSECTS / INEVITABLES
Our houses are treated periodically for pests, but since Florida is a tropical environment some bugs may show up depending on the season. The vacation property is treated every 3 months as part of a pest and termite control program, and is cleaned after each rental. We do not have control of it and will not provide a refund for such matter.
24. LOST AND FOUND
ACO Vacation Homes is not responsible for any lost or personal items left behind at the property or resort. Although we will not be held responsible for any of these examples, we do make every effort to locate and return items to our Guests. Guest will pay for shipping and handling charges necessary to return item(s). Any personal property found by ACO Vacation Homes will be kept at our office no more than 7 calendar days from the Guest's departure date. Unclaimed item(s) will be discarded after the 7-day period. Reservation holder must present a valid identification document to pick the item up or to have it delivered. In case of a third party is involved, the reservation holder must send a written authorization with the full name of the person who will be handling the process or pick up.
25. GUEST PERSONAL BELONGINGS
ACO is not responsible for damaged, lost or stolen personal items left in the property at any time during Guest's stay or cleaning. Guest has sole responsibility for their own items and has been informed to keep windows and doors always locked.
26. CANCELLATION POLICY
Cancellations must be confirmed in writing and must be made by 12:00 P.M. CST (Central Standard Time) on the appropriate day. Cancellation requested with less than 15 days prior to arrival, 100% of the total price of the reservation will be applied as penalty. No refunds applicable.
27. NO-SHOW
If Guest fails do appear at the scheduled check-in time, this will result in noncompliance with these regulations and ACO Vacation homes will not allow access to the property. Refund for the money paid for the rental will be not provided.
28. NATURAL DISASTER POLICY
ACO Vacation homes will not held any liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas and electricity, outside construction noises or plumbing. Neither for any loss or damage caused by weather conditions, natural disasters or other reasons beyond its control. Therefore, we strongly encourage Guests to purchase trip insurance. There will be no refund or reschedule trips due to any kind of these situations. Cancellations are subject to cancellation penalty.
29. RESCHEDULING AND CHANGES
There will be no refund due to changes to Guest's reservations (date changes, reducing the number of days, booking extension) if requested less than 15 days prior to check in.
30. PACKAGE DELIVERY/ MAIL SERVICE POLICY
DO NOT HAVE any items or packages delivered to the property. ACO Vacation Homes will not be responsible for any mail or package sent to the property. ACO Vacation Homes is a management company responsible for the good maintenance of the properties, with no access to the property's mail box. If Guest would like to make purchases online, we offer a package holding service, which allows Guest to send and pick up packages at our office. It costs $25.00 plus taxes (twenty-five dollars) for up to five packages and five dollars for each extra package after the initial five (e.g. two packages would cost $25, while six packages would cost $30). Guest can set the packages to arrive during the two weeks prior to Guest's check-in date and during Guest stay. Each individual package must not weigh more than 20 lb. (9 kg) or have any dimension that exceeds 40 in. (101 cm.). Pick up must occur before Guest's check-out date. Packages can only be picked up Monday through Friday from 9:00 a.m. to 5:00 p.m. Any package that is left at the office after check-out will be discarded. Guests agree that in case of packages with different dimensions of the description above there will be a penalty of $25.00 (twenty-five dollars) plus taxes per package. ACO Vacation Homes is not responsible for damaged, lost, stolen or not delivered packages. Office location: 11951 International Dr., Unit 2D3, Orlando, FL 32821.
31. OTHER INFORMATION
Guest is aware that we have a manual instruction for the appliances in the house, a note on the A/C thermostats as a reminder of how to use it, and a Book with all our rental rules. Guest is also aware that we have an emergency phone line to contact us after business hours: (407) 326-9400 and agrees that all our contact information has been provided.
32. ATTORNEY'S FEES
If Homeowner and/or ACO Vacation Homes employs an attorney due to Guest's violation of the terms and conditions of this agreement, Guest shall be responsible for all costs and reasonable attorney's fees as incurred by the Homeowner. Homeowner and Guest waive the right to demand a jury trial concerning any litigation between Homeowner and Guest.
33. HOLD HARMLESS
ACO and Homeowner attempt to properly maintain the property. The Guest agrees to immediately notify ACO of any maintenance problem, so that the situation can be remedied as soon as possible. ACO and Homeowner are not responsible for any inconvenience that may occur for which they have no control. This includes, but is not limited to: power outages, adverse weather conditions, mandatory evacuation, construction, mechanical failure such as pool pump, hot tubs, television, etc. No refunds will be given for occurrences beyond the ACO and Homeowner's control. ACO and Homeowner shall not be held liable for any injuries that may occur to Guests or any additional guests as a result of the acts of said Guests and their additional guests. ACO and Homeowner are not responsible for any theft or damage to Guest's belongings during their stay on the property.
Guest/credit card holder agrees with all rental terms, agrees to provide all required documents, sign and send agreement required by us to receive check in instructions (Voucher). Noncompliance of all requests above, will result in no access to the property. Unfortunately, we will not be able to accommodate any Guest without agreeing with full terms of our rental rules and regulations specified above, no exception.
